San Diego Coastkeeper and members of the California Coastkeeper Alliance continue to challenge the State Water Board's failure to properly implement an improved monitoring program as part of the statewide Construction Permit, as required by Court order in July 2000. The State Board has essentially ignored the Court's Writ, which ordered the agency to implement sampling and analysis procedures to determine whether compliance with water quality standards has been achieved. Coastkeeper has provided comments on the latest iteration of the permit, which is expected to be considered for adoption in 2004.
